1. Who these terms apply to
These terms apply to you if you use the Website in the course of a trade, business, craft or profession. That includes every Property Boutique Representative and every Independent Service Provider.
By listing on the Website, creating a professional profile, or accepting an enquiry through the Website, you confirm that you accept these terms.
These terms do not apply to consumers. Nothing in them affects the rights of any consumer who deals with you.

3. Definitions
- “Business User”, “you” and “your” mean a person to whom these terms apply under clause 1.
- “Consumer” means an individual acting wholly or mainly outside their trade, business, craft or profession.
- “Content” means any text, image, video, floor plan, document, price, description or other material you publish on or send through the Website.
- “Independent Service Provider” means a third-party estate agent, property manager, tradesperson or other business that advertises services on the Website but is not part of our branded network.
- “Platform Services” means the directory, the Verified Listing upgrade, any paid subscription, and the other services we provide through the Website.
- “Representative” means a self-employed Spanish professional (autónomo) authorised by us to use the Property Boutique brand.
- “Website” means Property Boutique at https:/propertyboutique.es.
4. Joining the Website and the information you must give us
4.1 Information required before you can offer services
Before you may offer services to consumers through the Website, you must give us the following and keep it accurate and up to date:
- your name, address, telephone number and email address;
- a copy of an identification document, or another accepted form of electronic identification;
- your payment account details;
- the trade register or similar public register in which you are entered, and your registration number in it;
- your professional registration or licence number where your activity is regulated, including any registration required under Andalusian rules;
- evidence of professional indemnity insurance where your activity requires it;
- your Passport or NIF or NIE ino, and your VAT number, or confirmation that you are not registered for VAT;
- confirmation that you undertake to offer only services that comply with applicable UK, EU and national law.
4.2 Verification
We will make reasonable efforts to check that this information is reliable and complete, using publicly accessible official databases and other reliable sources. If we consider information to be inaccurate or incomplete, we will ask you to correct it and may suspend the Platform Services until you do.
4.3 Information shown to consumers
Your name, address, contact details, register and registration number, professional or licence number, will be displayed on your listings so that consumers can see who they would be contracting with.
5. Your obligations and standards
You agree that:
- you will comply with all laws that apply to your activity, including Spanish and Andalusian property, tourism, consumer protection, tax and anti-money laundering law;
- you will hold and maintain every licence, registration, permission and insurance your activity requires;
- you will deal with consumers fairly, honestly and with reasonable care and skill;
- you will respond to enquiries received through the Website within 7 working days;
- you will not advertise a property or product you have no authority to market, or a service you are not qualified or entitled to provide;
- you will make clear to every consumer, before they instruct you and on every document you issue, that they are contracting with you and not with Infinitech Worldwide Ltd, and you will give them your legal name, NIF or NIE, registration number and insurer;
- you will carry out in your own name any activity that requires a regulated status, including holding client money, anti-money laundering checks, negotiating offers and issuing agency contracts;
- you will tell us promptly if you lose a licence, registration or insurance, if you become insolvent, or if you become subject to a regulatory investigation or a consumer complaint that is escalated to an authority;
- you will comply with our code of conduct and service standards.
6. Use of the Property Boutique brand
This clause applies to Representatives only.
We grant you a non-exclusive, non-transferable, revocable licence to use the Property Boutique name and logo solely to market the services you provide through the Website, and only in accordance with your authorisation agreement and our brand guidelines.
You must not register or attempt to register any trade mark, company name, trading name or domain name that includes or resembles the Property Boutique name or logo. You must not use the brand in a way that suggests you are our employee, agent, branch or subsidiary.
Your right to use the brand ends immediately when your authorisation ends or when these terms end. You must then stop using the name and logo across all materials, including signage, vehicles, business cards, email signatures, websites and social media, within 28 days.
Nothing in these terms creates a partnership, joint venture, employment relationship, franchise, or relationship of principal and agent between us. You have no authority to enter into contracts on our behalf, to make representations on our behalf, to receive money on our behalf, or to bind us in any way.
7. Your listings and content
7.1 Accuracy
You are solely responsible for your Content. It must be accurate, current and lawful, must not be duplicated, and must not advertise a property, product or service at a price at which it is not genuinely available. Listings must comply with all applicable advertising and property marketing rules, including Decreto 218/2005 where it applies.
7.2 Rights in your content
By uploading Content you confirm that you own it or hold all the rights and licences needed to grant the licence in clause 7.3, including the rights of any photographer, videographer, floor-plan provider, architect or stylist; that it does not infringe anyone’s rights; that you have the consent of any identifiable individual shown; and that you have the owner’s authority to market any property featured. You must keep evidence of your image licences and produce it to us on request.
7.3 Licence you grant us
You grant Infinitech Worldwide Ltd. a worldwide, non-exclusive, royalty-free, sub-licensable and transferable licence to host, store, reproduce, adapt (including resizing, cropping and watermarking), publish, display, distribute and communicate your Content to the public, in order to operate, promote and improve the Website, to syndicate listings where you have chosen that option, and to market the Website. This licence lasts while your Content is published and for a reasonable period afterwards to allow for backups, caches and archived copies, and continues for any copy already syndicated.
7.4 Syndication
We do not currently syndicate listings to third parties however we may send listings to a channel or partner owned by or associated with Infinitech Worldwide Ltd. or Property Boutique. Syndication does not affect ownership of intellectual property rights in your Content.
8. Ranking and paid placement
8.1 Main ranking parameters
Listings and professional profiles are ranked in search results and directory pages by reference to the following main parameters, in decreasing order of importance:
- Relevance to the search terms and filters the user has entered, including location, property type and price range.
- Completeness and quality of the listing, including the number and quality of photographs, the presence of required documents, and the length and detail of the description.
- Verified status, so that listings we have checked appear above unchecked listings of similar relevance.
- How recently the listing was created or last updated.
- Paid placement, where a business user has purchased a featured position or a subscription tier that includes enhanced visibility.
- Responsiveness, measured by how quickly and how often you reply to enquiries received through the Website.
Relevance carries the greatest weight because a result that does not match what the user is looking for has no value to them. Completeness, verification and recency come next because they are the strongest available indicators that a listing is genuine and still available. Paid placement can improve position within a set of relevant results, but it cannot cause an irrelevant listing to be shown ahead of a relevant one. Responsiveness is applied last, as a tie-breaker.
8.2 Paid placement
You can influence your visibility by Verified Listing and paying the associated administration fee. The effect of each is described on the page Get Verified. Every listing whose position is influenced by payment is labelled as sponsored or featured on the page where it appears.
8.3 Changes to ranking
We may change these parameters. Where a change would materially affect business users, we will give notice under clause 13.
9. Differentiated treatment
We do not offer property or professional services of our own in competition with business users, and we do not hold any interest in the transactions you conclude.
The only differences in how we treat business users are those arising from the paid products described in clause 8.2, which are available to all business users on the same terms and at the same prices, and from Verified status, which is available to any business user who provides the documents listed in our Terms of Use. We do not give any business user preferential access to data, to services, or to technical interfaces.
10. Fees, subscriptions and payment
10.1 Free listing
A standard listing and a standard professional profile are free of charge. We also offer a free “Verified” status.
10.2 Paid products
Current prices for Verified Listings, featured placements and subscriptions are on the page Get Verified. Prices are shown in euros (€) and include IVA/VAT. Where a reverse charge applies, you are responsible for accounting for the tax.
10.3 Subscription term and renewal
A subscription runs for the period shown at purchase and renews automatically unless you cancel before the renewal date. We will remind you at least 14 days before each renewal. Cancellation takes effect at the end of the paid term. We do not refund the unused part of a term.
10.4 Price changes
We will give at least 30 days’ notice of any price increase. You may cancel before it takes effect.
10.5 Refunds
The consumer right to cancel does not apply to business users. Fees for a Verified Listing are non-refundable once verification has begun, except where we fail to perform the service.
10.6 Late payment
Payments are processed by Stripe, PayPal or Bizum. If a payment fails or is reversed, we may suspend the Platform Services until payment is made, and may charge our reasonable recovery costs together with interest at 4% a year above the Bank of England base rate.
10.7 No transaction commission
We do not charge commission on any sale or let, and we take no share of the fees you charge your clients.
11. Access to data
This clause describes the access you have to data provided for, or generated through, the Website.
- Data you give us. You can view, correct, export and delete the information in your account and your listings at any time through your dashboard.
- Enquiries and leads. Enquiries sent to you through the Website are made available to you in full, including the enquirer’s name, contact details and message. You receive them as a separate and independent data controller and must handle them in accordance with clause 20.
- Performance data. You can see views, enquiries, saves and response times for your own listings and profile. You cannot see the corresponding data for other business users.
- Aggregated data. We do not give business users access to aggregated data covering the Website as a whole or the activity of other business users. We may publish general market statistics that do not identify any business user.
- Sharing with third parties. We share your listing data with any syndication partner you have selected under clause 7.4, and with our hosting, analytics and payment providers. We do not sell business user data.
- After termination. You may export your listings and enquiry history for 30 days after these terms end.
12. Restriction, suspension and termination
12.1 Restriction or suspension of individual content
If we restrict or suspend the Platform Services in respect of individual listings or content, we will give you a statement of reasons in writing before or at the time the restriction takes effect. The statement will set out the facts and circumstances we relied on, whether we acted on a report from a third party or on our own checks, the grounds we relied on, and how you can challenge the decision under clause 14.
12.2 Termination
If we decide to end the Platform Services to you altogether, we will give you at least 30 days’ notice in writing, with a statement of reasons. The 30-day period does not apply where:
- we are under a legal or regulatory obligation to end the service;
- we exercise a right of termination under an imperative reason of national law; or
- you have repeatedly breached these terms.
12.3 Immediate suspension
We may suspend your account immediately, with a statement of reasons, where we reasonably believe that you have lost a licence, registration or insurance that your activity requires, that you are misrepresenting your status or qualifications, that you are engaged in fraud, or that your continued listing presents a risk of serious harm to users.
12.4 Your right to end
You may end these terms at any time by closing your account. Fees already paid are not refundable except as stated in clause 10.5.
12.5 Effect of ending
When these terms end, your listings are removed, your right to use the Property Boutique brand ends immediately, and clauses 7.3, 11, 17, 18, 20, 21, 22 and 23 continue to apply. Ending does not affect any contract you have already concluded with a client.
12.6 Reinstatement
If a restriction, suspension or termination is reversed following a complaint under clause 14, we will reinstate you without undue delay.
13. Changes to these terms
We will notify you in writing of any proposed change to these terms. The change will not take effect for at least 15 days after we notify you, or for a longer period where you would reasonably need more time to make technical or commercial adaptations.
You may end these terms before the notice period expires, by giving notice that takes effect within 15 days of receiving ours. If you submit new listings after we have notified you, other than listings you were already required to submit, you waive the notice period.
The notice period does not apply where a change is required by a legal or regulatory obligation, or where it is exceptionally necessary to address an unforeseen and imminent danger to the Website, to users or to business users.
14. Internal complaint handling
You may complain to us free of charge about:
- our alleged failure to comply with any obligation we owe you under these terms or under applicable platform-to-business rules;
- technological issues with the Website that materially affect you; or
- measures we have taken, or our conduct, where these materially affect you.
Send complaints to admin@propertyboutique.com. We will consider each complaint and any link it has to other complaints, deal with it swiftly and effectively taking account of its importance and complexity, and give you the outcome individually in plain and intelligible language. We will acknowledge within 5 working days and respond substantively within 20 working days.
We publish annual information on the operation and effectiveness of this system which is available to you through your user dashboard.
15. Mediation
We are willing to engage in good faith with recognised mediators to try to settle any dispute with a business user about the Platform Services, including complaints not resolved under clause 14:
The mediator must be independent and impartial, affordable for a small or medium-sized business, can work in the language of these terms, are accessible from the place where you are established, can act quickly and at a distance, and understand business-to-business commercial relations. We will not bear costs of mediation in each case. Mediation does not stop either of us from starting court proceedings at any time.
16. No circumvention
You must not use the Website to move users away from it in order to avoid a fee properly payable to us. You must not use contact details obtained through the Website for any purpose other than responding to the enquiry for which they were given, and you must not add them to a marketing list without a separate lawful basis and, where required, consent.
17. Liability
17.1 What we never exclude
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.
17.2 Losses we exclude
Subject to clause 17.1, we are not liable to you for loss of profit, loss of business, loss of revenue, loss of anticipated savings, loss of contract, loss of goodwill, loss of reputation, loss or corruption of data, or any indirect or consequential loss, however caused.
17.3 Limit on our liability
Subject to clause 17.1, our total liability to you arising out of or in connection with the Website and the Platform Services, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the greater of the total fees you paid us in the 12 months before the event giving rise to the claim, and £500.
17.4 No guarantee of business
We do not guarantee any level of enquiries, leads, listings, visibility or income. We do not guarantee that the Website will be available without interruption or free from error.
17.5 Other users
We are not responsible for the acts or omissions of any user, client, other business user or third party you deal with through the Website, or for the accuracy of anything they tell you.
18. Indemnity
You agree to indemnify us against all liabilities, costs, expenses, damages and losses, including reasonable legal fees, that we suffer or incur arising out of or in connection with:
- your breach of these terms or of our Terms of Use;
- any claim that your Content infringes a third party’s rights;
- any claim brought by a consumer, counterparty or authority in relation to services you supplied or held yourself out as able to supply;
- your use of the Property Boutique name otherwise than in accordance with clause 6;
- any breach by you of data protection law in relation to personal data you received through the Website.
19. Insurance and regulatory compliance
You must hold and maintain professional indemnity insurance appropriate to your activity, and public liability insurance (seguro de responsabilidad civil) where your activity involves attending property. You must provide evidence of cover on request and tell us immediately if cover lapses.
Where your activity is regulated, you must hold and maintain the required registration in your own name, and comply with any registration obligation under Decreto 31/2024 or any successor rules. Property Boutique and Infinitech Worldwide Ltd. does not hold any regulated status and cannot cover your activity under its own status.
20. Data protection
Infinitech Worldwide Ltd. and each business user act as separate and independent data controllers for personal data they hold. We are not your processor and you are not ours.
When you receive an enquiry or client data through the Website, you become the controller of that data. You must process it in accordance with the UK GDPR, the EU GDPR and Ley Orgánica 3/2018, provide your own privacy notice, respond to data subject requests that relate to your processing, keep the data secure, and retain it no longer than necessary. You must notify us within 24 hours of becoming aware of any personal data breach affecting data you received through the Website.

21. Intellectual property
All content on the Website that we publish, including text, images, logos, branding, page layouts, software and design, is owned by or licensed to Infinitech Worldwide Ltd. We are the maker and owner of the database made up of the listings, professional profiles and related data on the Website, and we assert the database right in it.
You must not extract or re-use the whole or a substantial part of that database, must not repeatedly extract or re-use insubstantial parts, and must not use any automated means to access, monitor, copy or extract data from the Website. You must not use content or data from the Website to train, fine-tune or evaluate any machine learning or artificial intelligence model without our written consent.
22. Governing law and jurisdiction
These terms, and any dispute arising out of them or their subject matter, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
Any contract you enter into with a client is a separate agreement, normally governed by Spanish law and subject to the Spanish courts. Infinitech Worldwide Ltd. is not a party to those contracts.
23. General
23.1 Entire agreement
These terms, together with our Terms of Use, Privacy Policy and, for Representatives, the authorisation agreement, form the entire agreement between us and replace any earlier agreement or understanding. You confirm that you have not relied on any statement or representation not set out in these documents. Nothing in this clause limits liability for fraudulent misrepresentation.
23.2 Order of precedence
If there is a conflict, the following order applies: the authorisation agreement (for Representatives), then these Business User Terms, then the Terms of Use.
23.3 Severability
If any provision is held to be invalid, illegal or unenforceable, it will be severed and the rest will continue in full force.
23.4 No waiver
A delay or failure by either of us to enforce a provision is not a waiver and does not prevent later enforcement.
23.5 Assignment
We may transfer our rights and obligations to another organisation, including on a sale or reorganisation of our business. You may not transfer your rights or obligations, or subcontract your listing, without our written consent.
23.6 Third-party rights
These terms do not give any rights under the Contracts (Rights of Third Parties) Act 1999 to anyone who is not a party to them.
23.7 Notices
Notices to us must be sent to admin@propertyboutique.com and, where the notice concerns legal proceedings, to our registered office at Infinitech Worldwide Ltd. High Street, Sunninghill, Ascot, Berkshire, SL5 9NE. Our Spanish office is for correspondence only and service of legal proceedings there is not valid service. Notices to you will be sent to the email address on your account and are treated as received on the day sent, unless we receive a delivery failure message.
23.8 Force majeure
Neither of us is liable for any failure or delay caused by an event beyond our reasonable control, including natural disaster, epidemic, act of government, war, terrorism, civil disturbance, strike, failure of a utility or telecommunications network, failure of a third-party hosting or payment provider, or cyber attack.
23.9 Headings
Headings are for convenience only and do not affect interpretation. “Including” means “including without limitation”.
