1. About this notice
This Legal Notice sets out the identifying and legal information that an online service provider is expected to publish. It is written to satisfy, in a single place:
- the trading disclosure requirements that apply to a UK company under the Companies Act 2006 and the Company, Limited Liability Partnership and Business (Names and Trading Disclosures) Regulations 2015;
- the information requirements for online providers under the Electronic Commerce (EC Directive) Regulations 2002 and the Provision of Services Regulations 2009;
- the information a Spanish reader expects to find in an aviso legal under Article 10 of Ley 34/2002 (LSSI-CE); and
- the contact-point and representative information required by Regulation (EU) 2022/2065 (the Digital Services Act).
Publishing it in one document is a deliberate choice. Users of this website are based in the United Kingdom, in Spain, across the European Union and outside Europe altogether, and they should not have to work out which set of rules we sit under.
This notice is information about us. It is not a contract. The contractual terms on which you use the Website are in our Terms of Use and, for business users, our Business User Terms.

We are not obliged to communicate solely by automated tools, and you will always be able to reach a person during operating hours (and oftern outside those hours - detailed on our support page. Whenever possible, we will redirect you where needed to a person who speaks your language.

This office is used for platform administration, community support and correspondence only. It is not a registered branch (sucursal), not a permanent establishment for regulated real estate activity, and it holds no personal data. Service of legal proceedings at the Spanish office is not valid service; notices concerning legal proceedings must be sent to the registered office in clause 2.1.

3. Our representative in the European Union
We are established in the United Kingdom and offer services worldwide including to users in the European Union. We have therefore designated a legal representative in the Union:

Mr. Jones acts as our representative both:
- for the purposes of Article 13 of Regulation (EU) 2022/2065 (Digital Services Act), and may be addressed by users, Member State authorities, the European Commission and the European Board for Digital Services on all matters necessary for the receipt of, compliance with and enforcement of decisions issued in relation to that Regulation; and
- for the purposes of Article 27 of the EU General Data Protection Regulation, and may be addressed by data subjects and supervisory authorities on all questions relating to the processing of personal data.
Designating a representative does not transfer our own responsibility. Infinitech Worldwide Ltd. remains liable for compliance, and you can always deal with us directly at the addresses in clause 2.3.

4. A UK company trading online
4.1 Where we are established
Infinitech Worldwide Ltd. is established in the United Kingdom. Our company, our staff of record, our contracting entity, our accounting and our data infrastructure are all in the UK. We deliver the Website and the Platform Services from the UK, over the internet, to wherever you happen to be.
We say this plainly because it has real consequences for you, and because a website with a .es address and a Málaga phone number could easily give a different impression. The Spanish presence described in clause 2.4 is an office for people, not a legal establishment.
4.2 The law we operate under
As a UK-established provider we operate under UK law, including the Companies Act 2006, the Electronic Commerce (EC Directive) Regulations 2002, the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Consumer Protection from Unfair Trading Regulations 2008, the UK GDPR and the Data Protection Act 2018, the Privacy and Electronic Communications Regulations 2003, and the Online Safety Act 2023.
4.3 Why that does not put us outside European rules
Since 1 January 2021 the internal market (country of origin) principle in Directive 2000/31/EC no longer covers providers established in the United Kingdom. A UK provider offering services into the European Economic Area cannot rely on its home-state rules alone, and may be subject to the rules of each Member State whose users it serves.
We accept that position rather than argue with it. Where a European or national rule applies to what we do – the Digital Services Act, EU and Spanish consumer protection law, the EU GDPR, Spanish property marketing rules that bind the professionals in our network – we comply with it, and this notice and our Terms of Use are written accordingly.
4.4 Our commercial model
We charge optional platform fees only, such as the Verified Listing administration fee and any subscription. We take no commission on any property transaction and receive no payment calculated by reference to the value or completion of a transaction. We do not hold client money, and we do not handle deposits, rents or purchase funds. Payments for platform fees are processed by Stripe, PayPal or Bizum; we do not store full card details.
5. Users outside the United Kingdom
5.1 Who this website is aimed at
The Website is directed principally at people interested in property in Andalusia and the Costa del Sol, and at the professionals who serve them. It is written in English and available in further languages by machine translation (clause 18).
5.2 Access from anywhere
The Website is accessible worldwide, but we make no representation that its content, the listings on it, or the services of the professionals listed on it are appropriate, lawful or available in every country. If you access the Website from outside the United Kingdom or the European Union, you do so on your own initiative and you are responsible for compliance with your own local law.
5.3 Nothing here is an offer where it may not be
Nothing on the Website is an offer or solicitation in any jurisdiction where such an offer or solicitation would be unlawful, or to any person to whom it would be unlawful to make it. Nothing on the Website is an offer of securities, a collective investment scheme, a financial promotion, credit, mortgage or insurance mediation, or investment advice.
5.4 Sanctions and restricted parties
We do not provide paid Platform Services to any person or entity subject to UK, EU, UN or other applicable sanctions, or resident in a territory subject to comprehensive sanctions. We may decline or reverse a transaction where a sanctions screening obligation requires it.
5.5 Currency and tax
Prices are shown in euros (€) and include VAT or Spanish IVA where it applies. You are responsible for any withholding tax, import charge, bank charge or currency conversion cost arising in your own country.
6. What we do, and what we are not
6.1 What we do
We operate a platform. Through it you can browse and publish property and service listings free of charge, ask to be put in touch with a Property Boutique Representative or an Independent Service Provider, purchase an optional Verified Listing, and read general information about the Spanish property market.
6.2 What we are not
Infinitech Worldwide Ltd. is not an estate agent, property broker, property manager, letting agent, intermediary, notary, lawyer, gestor, surveyor, valuer, mortgage broker or insurance intermediary. In particular we do not hold client money, negotiate or transmit offers, conclude sales or lettings, carry out anti-money laundering checks on parties to a transaction, conduct viewings, issue agency contracts or agency commission invoices, or take any transaction-based fee.
Every property service described anywhere on this website is provided by a Representative or an Independent Service Provider, each of whom contracts with you in their own name, under their own registrations and their own professional indemnity insurance. Your contract for that service is with them, not with us. Nothing in our authorisation of a Representative to use the Property Boutique brand creates a partnership, franchise, joint venture, employment or agency relationship, and no Representative or Provider has authority to bind us.
6.3 Verified Listings
A Verified badge records only that, on the date of application, we received and reviewed certain documents and found them consistent with the listing. It is a trust signal. It is not a survey, valuation, legal opinion, investigation of title, or warranty about any professional. See clause 6 of our Terms of Use.
7. Legal position in Spain
We are a UK-based platform operator. We do not carry out intermediación inmobiliaria and we do not carry out any activity that requires registration as a real estate agent under Spanish law.
In Andalusia, Decreto 31/2024 provides for a mandatory register of real estate agents, with a transitional period ending on 24 January 2028. Because we do not carry out real estate intermediation, that registration requirement does not apply to us. Representatives and Independent Service Providers who do carry out regulated activity must comply with any registration obligation applying to them, and must satisfy us that they do.
Information published on the Website about Spanish and Andalusian law – including Decreto 218/2005 on property marketing, the Ley de Arrendamientos Urbanos, the 2023 Housing Law and the rules on Viviendas de Uso Turístico – is general information, correct to the best of our knowledge on the date shown at the top of this page. Spanish property, tourism and housing law changes frequently and regional rules differ.
8. Our status as an online intermediary
8.1 Hosting service
In respect of listings, images, reviews, comments and other material uploaded by users, we act as a hosting service provider. That material is provided by users, not by us. We do not pre-approve it and we are under no general obligation to monitor it or to seek out unlawful activity.
We are, however, responsible for acting once we know. Where we obtain actual knowledge of illegal content we act expeditiously to remove it or disable access to it, in line with Articles 6 and 16 of Regulation (EU) 2022/2065 and Regulation 19 of the Electronic Commerce (EC Directive) Regulations 2002.
8.2 Notice and action
Anyone can report content they consider illegal, by email to admin@propertyboutique.es or through the “Report” link on any listing page. We confirm receipt without undue delay, decide in a timely, careful, non-arbitrary and objective way, give the affected user a statement of reasons, and tell you how to challenge the decision. The full procedure, including internal complaint handling and out-of-court dispute settlement under Articles 20 and 21 of the Digital Services Act, is in clause 14 of our Terms of Use.
8.3 Orders from authorities
Where a competent judicial or administrative authority orders us to act against illegal content, or to provide information about a user, we comply, we inform the authority of the effect given to the order, and we tell the affected user unless the law or the authority prevents us.
8.4 Online safety
Because users can share content with one another on the Website, we treat it as a user-to-user service with links to the United Kingdom for the purposes of the Online Safety Act 2023, and we operate reporting, moderation and complaint routes accordingly.
9. Content, accuracy and advice
We do not verify listings beyond the limited checks described in clause 6.3. Descriptions, prices, photographs, measurements, availability, licences and permissions are supplied by third parties and are their responsibility.
Everything we publish ourselves – guides, market commentary, explanations of Spanish law and practice – is general information only. It is not legal, tax, financial, surveying, planning or investment advice, it may not reflect the most recent changes in the law, and it takes no account of your circumstances. Always obtain independent professional advice, from a Spanish abogado or gestor where the matter concerns Spanish property, before entering into any transaction.
10. Intellectual property, database rights and data mining
10.1 Our rights
All content we publish on the Website – text, images, logos, branding, page layouts, software and design – is owned by or licensed to Infinitech Worldwide Ltd. and protected by copyright, database rights, trade mark rights and other intellectual property laws in the UK, in Spain and internationally under the Berne Convention.
10.2 Database right
We are the maker and owner of the database comprising the listings, professional profiles and related data on the Website, and we assert the database right in it. You must not extract or re-use the whole or a substantial part of it, and must not repeatedly extract or re-use insubstantial parts in a way that conflicts with our normal exploitation of it.
10.3 Trade marks
“Property Boutique” and the Property Boutique logo are trade marks of Infinitech Worldwide Ltd. A Representative may use them only under a current authorisation agreement, and that right ends immediately when the authorisation ends.
10.4 Text and data mining
We expressly reserve our rights in relation to text and data mining under Article 4(3) of Directive (EU) 2019/790 and under the Copyright, Designs and Patents Act 1988. Content and data on this Website may not be used to train, fine-tune, evaluate or ground any machine learning or artificial intelligence model, nor for text and data mining of any kind, without our prior written consent. This reservation is also expressed in machine-readable form in our robots.txt file.
10.5 What you may do
You may view the Website and print or download extracts for your own personal, non-commercial use. You must not modify copies, separate an image from its accompanying text, or use any content commercially without our written consent.
10.6 Notices
Send intellectual property complaints to admin@propertyboutique.es with the information listed in clause 14.2 of our Terms of Use. We operate a repeat-infringer policy.
11. Data protection
Infinitech Worldwide Ltd. is the data controller for personal data collected through the Website, and processes it in accordance with the UK GDPR, the Data Protection Act 2018 and, where it applies, the EU GDPR. Personal data is held on our own infrastructure in the United Kingdom.
Transfers of personal data from the European Economic Area to the United Kingdom are covered by the European Commission’s renewed adequacy decisions, adopted on 19 December 2025 and running until 27 December 2031, so no additional safeguards or contractual mechanisms are required.
Representatives and Independent Service Providers act as separate and independent data controllers for the personal data they collect when you engage them, under their own privacy notices and under Spanish data protection law including Ley Orgánica 3/2018.
How we collect, use, protect and delete your data, the lawful bases we rely on, and how to exercise your rights are set out in full in our Privacy Policy. Privacy questions and rights requests go to admin@propertyboutique.es. You may complain to the ICO in the UK, to the AEPD in Spain, or to the supervisory authority where you live or work.
12. Cookies
We use cookies and similar technologies. Nothing non-essential is set before you consent, refusing is as easy as accepting, and you can change your choices at any time through the cookie preferences link in the footer. Details are in our Cookie Policy.
13. Hosting and infrastructure

- Personal data storage: a separate hardened server operated by Infinitech Worldwide Ltd. in the United Kingdom, architecturally isolated from the public website and unreachable from the open internet

14. Third-party links and embedded content
The Website may contain links to third-party websites, resources and advertisements, and pages may include embedded content such as videos, images or articles. We provide links for information only, we have no control over that content, and we accept no responsibility for it or for any loss arising from your use of it. Embedded content behaves as if you had visited the other website directly, and that site’s own privacy policy governs what it collects.
15. Availability, security and liability
The Website is made available free of charge. We do not guarantee that it will always be available, uninterrupted or error-free, and we may suspend, withdraw, restrict or change it for business or operational reasons.
You are responsible for your own equipment, software and virus protection. You must not attempt unauthorised access to the Website or any connected system, introduce harmful material, launch a denial-of-service attack, or scrape the Website by automated means outside our robots.txt file. We report conduct we reasonably believe to be criminal, and co-operate with lawful requests to disclose identity.
Our liability to you is set out in clause 18 of our Terms of Use. Nothing in this notice or in those Terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.
16. Consumers: prices, cancellation and redress
16.1 Before you buy
The total price of any paid Platform Service, including all taxes and unavoidable charges, is shown before you confirm your order, and we send written confirmation by email.
16.2 Cancellation
If you are a Consumer you may cancel a paid Platform Service within 14 days of the day the contract is made, without giving a reason, by emailing admin@propertyboutique.es or using the model cancellation form in your dashboard. We refund within 14 days of being told, by the same payment method. If you asked us to begin the service during that period, you pay a proportionate amount for what has been done. This clause does not apply to Business Users.
16.3 Complaints
Complain to admin@propertyboutique.es or +34 951 741 911. We acknowledge within 5 working days and give a substantive response within 20 working days.
16.4 Out-of-court redress
- Consumer disputes: UK Consumers may refer a dispute to Citizens Advice. Consumers resident in Spain may use the Junta Arbitral de Consumo, the Hoja de Quejas y Reclamaciones system, or the consumer authorities of their Comunidad Autónoma. Consumers elsewhere in the EU may use an alternative dispute resolution entity listed by their Member State.
- Content and account decisions: you may take a moderation dispute to any out-of-court dispute settlement body certified under Article 21 of the Digital Services Act. In Spain the Digital Services Coordinator is the CNMC.
- The European ODR platform is closed. It was discontinued on 20 July 2025 by Regulation (EU) 2024/3228, and we therefore do not link to it. Use the routes above instead.
17. Governing law and jurisdiction
This notice, our Terms of Use and any dispute arising out of them or their subject matter are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
If you are a Consumer habitually resident in Spain or elsewhere in the European Union, that choice does not deprive you of the protection of the mandatory rules of the law of your country of residence. You may bring proceedings in the courts of your country of residence, and we will bring proceedings against you only in those courts.
Any contract you make with a Representative or an Independent Service Provider is a separate agreement, normally governed by Spanish law and dealt with by the Spanish courts. Infinitech Worldwide Ltd. is not a party to it.
18. Language
This notice is published in English and is available in over 100 further languages through the translation tool at the bottom left (top-left on mobile) of every page. The English version prevails, except where the law requires otherwise for Consumers resident in Spain. Contracts between us are concluded in English.
19. Accessibility
We aim to make the Website usable by everyone and are working towards conformance with WCAG 2.2 Level AA. If you have difficulty using any part of it, email admin@propertyboutique.es and we will help you and fix the problem.

21. Changes to this notice
We may update this notice. The current version is always published here with the date it took effect, and we do not amend it retrospectively. Where a change affects your rights or the identity of the entity you contract with, we will tell you before it takes effect.
